Employment-Based Visa Preferences

Visa preference is given to aliens with extraordinary abilities, professors or researchers, and executives and managers. Labor certification is not required under these categories, but an alien must offer substantive proof that he or she belongs into one of these categories.

Second preference goes to members of professions with advances degrees, and third preference goes to professionals with a U.S. bachelorís degree or an equivalent. Unless the INS gives the alien a waiver, labor certification is required under these categories.
