Does the motorist have a right to a private sobriety test? Again, it depends on the state. Many states do allow the driver to arrange for him or herself for a competent person to draw an independent sample of the suspectís blood and analyze it. Other states only allow an independent test after the driver has already submitted to the officerís breathalyzer test.
